Prospective Marriage Visa

Subclass 300

Visa Purpose

This visa allows you to enter Australia and marry your intended spouse (fiancé(e)) within the visa’s nine (9) month validity period.

The prospective marriage visa (subclass 300) stipulates that your fiancé(e) must be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen. This visa must be applied for offshore.

Who is eligible?
You must genuinely intend to marry your fiancé(e).
You must genuinely intend to live together as husband and wife.
You must be sponsored by an eligible sponsor.
Requirements
Must be legally able to marry.
Must be 18+ (or meet legal exceptions).
Must have met your partner in person.
Must meet Australian legal conditions.

Onshore Partner Visa

(Subclass 820 & 801)

Visa Purpose

This visa is for those in committed relationships on a married or defacto basis.

The onshore partner visa allows you to remain in Australia on the basis of your married or de-facto relationship with your partner on a temporary or permanent basis. This visa includes dependant children and other eligible dependent relatives.

Who is eligible?
Married Applicants: Your marriage must be legal under Australian Law.
There are some exceptions, such as same-sex, underage or polygamous marriages, which are not accepted in Australia. Same-sex couples are not eligible for this visa.
De Facto Applicants: You and your partner must have been in a de-facto relationship for the entire 12 months immediately prior to making application.
The 12-month requirement may be waived if (a) you can demonstrate compelling and compassionate circumstances or (b) you have registered your defacto relationship.
Requirements
You must be sponsored by an eligible sponsor (Australian citizen, permanent resident, or eligible NZ citizen).
You and your partner must show a mutual commitment to a shared life as husband and wife to the exclusion of all others.
You and your partner must be living together or, if not, any separation must be only temporary.
You must also have a genuine and continuing relationship with your partner.

Offshore Partner Visa

(Subclass 309 & 100)

Visa Purpose

This visa is for those in committed relationships on a married or defacto basis who currently reside outside Australia.

The offshore partner visa allows you to enter and remain in Australia on the basis of your married or de-facto relationship with your partner on a temporary or permanent visa.

This visa includes dependent children and other eligible dependent relatives.

Who is eligible?
Married Applicants: Your marriage must be legal under Australian Law.
Same-sex couples are not eligible for this visa (as married applicants).
De Facto Applicants: You and your partner must have been in a de-facto relationship for the entire 12 months immediately prior.
Waiver: The 12-month requirement may be waived for compelling circumstances or registered relationships.
Requirements
Sponsorship: You must be sponsored by an eligible sponsor (usually over 18).
Commitment: Mutual commitment to a shared life as husband and wife to the exclusion of all others.
Co-habitation: Living together or separation must be temporary.
Genuine Relationship: Must have a genuine and continuing relationship.

Parent Visa

(Subclass 103)

Visa Purpose

This visa allows parents to migrate to Australia permanently to join their children who are living in Australia.

To apply for this visa, it requires that you be sponsored by your child or another eligible sponsor currently residing in Australia. Note: There can be a very long waiting period for this visa.

Who is eligible?
Child's Status: Parent of a child settled in Australia (Citizen, PR, or eligible NZ citizen).
Sponsorship: Must be sponsored by an eligible sponsor (usually your child).
Under 18 Sponsors: Alternative sponsorship paths available if child is under 18.
Requirements
Assurance of Support: Must have a commitment for an Assurance of Support.
Balance of Family Test: Half your children must be permanently resident in Australia, or more reside in Australia than any other single country.

Contributory Parent Visa

(Subclass 143)

Visa Purpose

This visa allows parents to migrate to Australia permanently to join their children who are living in Australia.

This visa requires that you be sponsored by your child, or another eligible sponsor. By paying the contribution to the Australian government you accelerate processing and you can expect a decision much faster.

Who is eligible?
Child's Status: Parent of a child settled in Australia.
Sponsorship: Sponsored by an eligible sponsor.
Assurance of Support: Commitment for an Assurance of Support is required.
Requirements
Balance of Family Test: Half your children must be permanently resident in Australia.
Offshore Application: Applicants must be offshore to receive the visa.

Aged Parent Visa

(Subclass 804)

Visa Purpose

This visa is suitable for elderly parents who may or may not be dependent on their children. It allows aged parents to remain in Australia permanently.

You can apply for this visa onshore if no restriction exists. Your spouse and family members may also be included.

Child's Status: Parent of a settled Australian child.
Sponsorship: Sponsored by your child or eligible sponsor in Australia.

Visa Purpose

This visa allows aged parents to migrate to Australia permanently to join their children.

Requires sponsorship. You must be aged by definition (generally over 65) and this application is made onshore.

Who is eligible?
Age Requirement: Must be "Aged" by definition.
Child's Status: Parent of a settled child in Australia.
Sponsorship: Sponsored by eligible sponsor.
Requirements
Balance of Family Test: Required.
Assurance of Support: Required.
Onshore Application: Applied onshore if no restrictions.

Child (Permanent) (Subclass 101)

For children from overseas who are the child or stepchild of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Orphan Relative (Permanent) (Subclass 117)

For children from overseas whose parents are deceased, permanently incapacitated, or whose whereabouts are unknown and who have an eligible sponsor.

Adoption (Permanent) (Subclass 102)

In the case of the adoption of children from overseas by an Australian citizen, PR, or eligible NZ citizen.

Important:

If the child was adopted before the parent became an Australian citizen/PR, they must apply for Subclass 101 instead.

Dependent Child Visa (Subclass 445)

For children whose parent holds a temporary partner visa and is in the process of obtaining a permanent partner visa.

Humanitarian Program – Split Family

For the dependent children of people granted any permanent humanitarian visa (including Protection and Resolution of Status visas) in the last five years.

Remaining Relative Visa

Eligibility & Sponsorship
No Overseas Relatives: You cannot have any near relatives other than those who are usually resident in Australia.
Sponsorship: Sponsored by your sibling, parent, or their partner.
Visa Conditions
Subclass 115: Offshore visa, apply and accepted offshore.
Subclass 835: Onshore visa. Must hold substantive visa to apply.
Assurance of Support: Required.
